3 Keys To Keeping Your Company Out Of Court

By Eli Kantor Recently, there has been a huge upsurge in the number of sexual harassment lawsuits. It started with Anita Hills televised testimony at the Clarence Thomas Senate Confirmation hearing to become a Supreme Court Justice in 1991. Then Paula Jones lawsuit against President Bill Clinton and several multi-million dollar verdicts have caused a wave of litigation. In 1998, the U.S. Supreme Court handed down two important decisions that put the ball in the employers court in sexual harassment lawsuits. Basically, they gave employers what we call an affirmative defense, provided that they have a policy in place that makes it clear the company does not tolerate sexual harassment. This article will briefly summarize 3 keys to keeping your company out of court. KEY #1 - Have A Written Sexual Harassment Policy All employers should have a written sexual harassment policy, which at a minimum provides: What sexual harassment is; sets forth a mechanism for reporting it; states that all complaints will be promptly and thoroughly investigated, and that if a violation is found, that prompt and effective remedial action will be taken. KEY #2 - Communicate the Policy It does no good to merely have a sexual harassment policy that is sitting gathering dust in the Human Resources department or in an employee handbook, the policy must be communicated to all of the employees. It should be distributed to employees at the time of hire, explained to them, and have them sign acknowledging receipt and agreeing to abide by it. It should be posted on the wall and where appropriate, translated into Spanish. It should be discussed at meetings. Most important, it should be enforced and taken seriously whenever a complaint is made, so that employees will feel comfortable using it. KEY #3 Provide Training For Your Seminars Under a new law, AB 1825, California now requires all employees with 50 or more employees to provide a minimum of two (2) hours of sexual harassment prevention training to their supervisors. While it is not required for employers with less than fifty (50) employees, it still is an excellent idea, since it improves employee morale by preventing problems in the first place; teaches supervisors how to nip the problems in the bud; and if an employer is ever sued, the first question that they will be asked is: What have you done to train your supervisors about sexual harassment prevention? The employer can respond by providing the attendance sign-in sheet from the training seminar.I provide training to bring employers into compliance with the new law, and to protect them from costly lawsuits. First, I check their existing policy to make sure that it is adequate, or I draft a policy for them if they dont have one. Then I go out and meet with the managers on site. I define sexual harassment for them, and go through some hypothetical scenarios with them, so they understand what is and is not acceptable behavior in the workplace. Then I go over their policy with them, have them sign off that they have read it, understand it, and will be bound by it. I tell them that if they violate the policy, it may cost them their jobs. By Noah Stephens I used to have trouble falling asleep at night, but now I turn on the beautiful music of family radio and I feel comfort. I know that when I have this radio station on, I will not be bombarded by the temptations and sickness of the flesh and the world. Instead, I am blessed by Godly teaching. Not only is there plenty of biblical teaching and prophesy about how close we are to the end, there is also practical advice and information for everyday living. There’s a doctor that comes on at least twice a day to talk about common ailments like diabetes, asthma, etc. There’s other speakers that come on to talk about the importance of forgiveness, patience, and mercy. There’s other speakers that come on to talk about community issues like poverty and homelessness. In short, everything on family radio is Godly, not worldly. Harold Camping is the name of the President of family radio and he has some unusual beliefs that are hard to swallow for many people. However, Harold has studied the bible for longer than most of use have been alive. He has a program on every evening called the “Open Forum” where he takes questions from callers all over the United States. One of the most common questions he gets is how can the church age be over. I won’t attempt to get into his teaching in such a short article, but I invite you to listen to his program sometime and see for yourself how much sense it makes to you. Harold shows from the bible that the world begun in 1113 B.C. He has a book that was just released called “Time has an End” where he shows from the bible how the bible shows the age of the earth. He also explains how the great flood happened and how that skews the way scientist try to date things and come up with ages for the earth that are wrong. More important, Harold claims that the world will come to end in 2011 and this cause the most stir among Christians today. They will call can tell Harold that the bible says “no one knows the day or the hour”. And, Harold says that is corrrect, no one does know the day or the hour. But, that doesn’t mean that no one can know the year. He goes on to explain how in Noah’s day nobody believed Noah that he knew about the great flood. And, in just the same way many people will not believe Harold about the end of the world. The good news however, is that there is a great multitude which no man can number will be saved. Who knows, perhaps you are one of these saved individuals. If you are, you will be delighted by what you hear on this radio station. Employment Interviewing: Ask For The Job

By Virginia Bola, PsyD We walk into an interview with the unspoken assumption that the employer knows we want the job. Except for practice interviewing or cold calling, we put out the time and energy for an interview because we think the position is worthwhile and will be a good fit. The employer may be interviewing many people for one position and has to weigh the strengths and weaknesses of each candidate in a very short period of time. Quickly jotted interview notes reveal doubts about certain applicants and positive aspects of others. Whatever position is involved, from unskilled work to professional or managerial posts, employers overwhelmingly seek one major attribute: they seek to hire someone who really wants the position. If you are unemployed (head hunter or promotional positions provide a little more bargaining room), you need to make it crystal clear that you want the job, that you are committed to do whatever it takes, and that you are eager for the chance to perform, to please, and to exceed all expectations that have been outlined. Often, applicants are afraid to seem too eager, thinking that the employer will think that they are desperate and consequently that the salary offered will be lower. They play coy, stating that they need to think about it, that they have other irons in the fire, or that they are weighing different job offers. A lack of enthusiasm when pay and benefits are mentioned, or a lackluster response to the position’s details, rarely results in a positive response. Hiring managers or company owners believe that what they are offering is a gift that anyone with sense would snap up in an instant. If the applicant seems ambivalent about the offer, it subconsciously suggests that maybe this position isn’t good enough. The manager/interviewer vaguely senses that their own choice in working for this company may be regarded as a mistake. Ask directly for the job, even if you’re unsure about it. Display unabashed enthusiasm for this position, with this company, at this time, and make it clear to the interviewer that you want to start right away, eager to prove your skills and competence. More than one hiring decision has been determined by who seemed to want the job the most - a classic marker of those who will work hard and produce. If you decide later that it’s not for you, you can always decline but at least you gave yourself a choice. By John Furnem Today we know a lot more about depression, this disease is one of the common and dangerous mental conditions we can encounter in all societies and in all cultures, it is in fact, an across the board human situation which, in the last few years, significant achievements have been made. The understanding of depression and the recognition that it was, in fact, a serious mental condition, has brought about many opinions and researchers to try and discover more about the causes for depression and the ways to try and combat it. the modern ago, with psychoanalysis science and psychological research has discovered much about the human mind and spirit, and one of the most significant processes were the discovery of mental conditions that do not constitute a state of permanent mental disorder, these diseases were actually more like viruses, almost anyone had the unfortunate statistical chance of catching it, and everyone needed to know more about it so they could try and avoid it. Clinical depression is a serious medical condition that affects millions of people throughout the world. Also known as major depression disorder, clinical depression is experienced by various types of people in many different walks of life. Although most people experience a few terms of sadness throughout their lives, clinical depression is more than just a case of the blues, it is much more like a crashing force that does not let the person suffering from it to function properly, and sometimes even not function at all. It is estimated that clinical depression affects about sixteen percent of the world population. Imagine people suffering form depression 200 years ago, even 500 years ago, without proper understanding of this condition, many people throughout history have been outcastes and rejected from society just because of a case of depression. According to most studies, the average onset of a typical case occurs in the late 20s. Gender also plays a role; nearly twice as many females as males report or receive treatment for depression, though this difference seems to shrink after women reach the age of fifty, when most females have gone through menopause. Depression is currently the leading cause of disability in the United States and is expected to become the second leading cause of disability worldwide in the next twenty years or so. If you have ever seen a person that suffers from depression you are surely aware of the dangers or having this condition, life, with all its wonderful attributes is covered, and all that remains to a person with depression is the empty feeling of sadness, something this person can not just snap out of, even for a second, depression is a very serious thing, and we should all try to and know more about it. There are many different signs and symptoms of depression.
